Legislation Update to the Taking Control of Goods Regulations
The Statutory Instrument for the Taking Control of Goods (Miscellaneous Amendments) Regulations 2026 has been laid before Parliament and is due to come into force on 1st May 2026.
The key changes are as follows:
- The minimum notice period will increase from 7 clear days to 14 clear days
- The notice period may be extended to up to 28 days where requested by a debt advice provider before expiry (this does not apply to business debt)
- A 5% increase will be applied to the current fee scale
- Clarification has been provided that escalation to the second enforcement stage cannot take place at the first attendance where there has been no prior contact
