Eviction of Trespassers from Land and Buildings

This authorises and empowers Court Enforcement Services to effect the removal and eviction of Squatters and Trespassers on behalf of the landlord by invoking their common law rights to the Tort of Trespass in order to return the land or property back to the rightful owner.

Terms and Conditions:

We hereby authorise Court Enforcement Services to affect peaceful entry onto the land and/or buildings as our agents under our common law right, to quiet enjoyment of our land/and or buildings and remove any trespassers.

You are authorised to change locks and secure the premises/land if necessary, display necessary notice of eviction notices as required; and for doing so this shall be your sufficient Warrant, Authority and Indemnification against all Actions at Law, as well as costs, charges or expenses which are reasonably incurred by reason of executing this Warrant (in accordance with our published fee schedule and any other expenses in instructing third parties. Fee Schedules); and we thereby undertake not to hold you accountable for goods forcibly or clandestinely removed from the premises following their being made secure.

Where our agents have been forced to withdraw from an enforcement action due to circumstances outside of our control, for any reason whatsoever including but not limited to the Client standing us down on site, the site being vacant on our attendance or the Police issuing instructions to withdraw, our fees for attendance and time spent on site remain payable as quoted.

Where our planned attendance is delayed or cancelled by you or any other party, once our Enforcement Agents have already mobilised to site but not yet arrived, we reserve the right to charge 50% of any fees we have already quoted to you for the aborted attendance.

NB: Late payment charges will be applied to all our overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 (As Amended).

CONSENT AND NOTICE REGARDING ELECTRONIC INSTRUCTIONS TO COURT ENFORCEMENT SERVICES.

Electronic Signature Agreement.

By submitting these instructions to Court Enforcement Services Limited you are signing this document electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement.

By submitting this instruction document you consent to Court Enforcement Services Limited acting as Certificated Enforcement Agents on your behalf.

You further agree that your use of a key pad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise provide Court Enforcement Services Limited with instructions via our client web portal or online instructions constitutes your signature (hereafter referred to as "E-Signature"), acceptance and agreement as if actually signed by you in writing.

You also agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and Court Enforcement Services Limited.

You also represent that you are authorised to provide these instructions on behalf of the creditor and will be bound by the terms of this Agreement.

You further agree that each use of your E-Signature in instructing Court Enforcement Services Limited constitutes your agreement to be bound by the terms and conditions of the authorisation to act as enforcement agent of Court Enforcement Services Limited as they exist on the date of your E-Signature.
